Santé, Inc. (“Santé,” “we,” “our,” or “us”) values your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our point-of-sale, eCommerce, marketing, and related services (collectively, the “Services”). By using Santé, you agree to the practices described in this Privacy Policy.

1. Information We Collect

a. Information You Provide to Us

We collect information you provide directly, including:

  • Account Information: business name, store location, contact name, email address, phone number, login credentials
  • Merchant & Employee Data: employee names, roles, permissions, and activity within the platform
  • Customer Data (on behalf of merchants): names, email addresses, phone numbers, purchase history, loyalty activity, and marketing preferences
  • Payment & Transaction Data: transaction metadata, order details, refunds, and payment method tokens (payment card data is processed by PCI-compliant payment processors and is not stored by Santé)
b. Information Collected Automatically

When you use the Services, we automatically collect:

  • Device & Usage Data: IP address, browser type, operating system, device identifiers
  • Log Data: pages viewed, features used, timestamps, error logs
  • Cookies & Similar Technologies: used for authentication, security, analytics, and performance

2. How We Use Information

We use information to:

  • Provide, operate, and maintain the Services
  • Process transactions and enable payments
  • Support onboarding, training, and customer support
  • Improve product performance, reliability, and usability
  • Send operational communications (e.g. service updates, security notices)
  • Enable marketing features, including email and SMS messaging, at the direction of merchants
  • Detect fraud, abuse, and security incidents
  • Comply with legal and regulatory obligations

Santé does not sell personal data.

3. SMS & Messaging Communications

Santé may collect and process phone numbers for the purpose of sending transactional and/or marketing SMS (text) messages on behalf of merchants using the Services.

  • Message content, frequency, and campaigns are controlled by the merchant.
  • Message frequency varies.
  • Message and data rates may apply.
  • Recipients may opt out of all future SMS messages at any time by replying STOP.
  • Consent to receive SMS messages is not a condition of any purchase.
  • For assistance, recipients may reply HELP or contact the merchant directly.

Santé requires merchants to obtain explicit opt-in consent from recipients before sending SMS marketing messages and to comply with all applicable laws, including TCPA and carrier guidelines.

4. How We Share Information

We may share information only as necessary:

a. Service Providers

With trusted vendors who help us operate the Services (e.g. cloud hosting, analytics, payment processing, messaging infrastructure).

b. Payment & Messaging Providers

With PCI-compliant payment processors and SMS service providers to process transactions and deliver messages.

c. Legal & Compliance

If required to comply with applicable laws, regulations, legal processes, or enforce our agreements.

d. Business Transfers

In connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

5. Merchant Customer Data

Santé processes customer data on behalf of merchants. Merchants determine how customer data is collected, used, and marketed. If you are an end customer of a merchant using Santé, please contact that merchant directly regarding your data rights or marketing preferences.

6. Data Retention

We retain information only as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Merchants may request deletion of their data subject to applicable laws and contractual requirements.

7. Security

We implement administrative, technical, and organizational safeguards designed to protect information, including encryption, access controls, and monitoring. However, no system is completely secure, and we cannot guarantee absolute security.

8. Your Choices & Rights

Depending on your location, you may have rights under applicable data protection laws to access, correct, or delete your personal information, or to object to certain processing. Requests may be submitted to privacy@santehq.com.

9. Cookies & Tracking Technologies

We use cookies and similar technologies to operate the platform, maintain sessions, analyze performance, and improve user experience. You can control cookies through your browser settings.

10. Children’s Privacy

Santé is not intended for use by individuals under 13 years of age, and we do not knowingly collect personal information from children.
